TERMS OF SERVICE

Please read these terms carefully before commissioning the artist. By using this service, you agree to be bound by these terms:

WILL DRAW:

  • Fan arts

  • Original characters

  • Humans

  • Kemonomimi

  • Humanoids (limited)

WILL NOT DRAW:

  • Any forms of NSFW

  • Furry / Anthro / Animals

  • Heavy detailed props / designs

  • Mecha / Armor

  • Complex poses and BGs

GENERAL:

  1. The artist has the right to decline a commission at any circumstances. (e.g. not suitable for their style, not able to do a certain concept, not applicable to their current skills, etc.)

  2. Using commissioned artworks for NFTs and AI image generation is strictly prohibited.

  3. Clients who will display rude and unprofessional behavior or violate any of the terms will be blacklisted. For worse cases, a public callout/warning post will be posted on the artist’s social media account/s and will be reported in arts and commissions forums, servers, groups, etc.

PROCESS & DELIVERY:

  1. Clients are required to provide visual references and/or sketches. Please minimize pure text descriptions as much as possible.

  2. Please refer to the estimated turnaround time in each commission's description. These timeframes may extend, but the artist will inform the client in advance.

  3. Rushed commissions are highly discouraged, but the client must discuss it first with the artist. Additional fees may apply.

  4. Clients may refer to the artist’s work queue to check the status of all commissions.

  5. Final outputs will be sent through Email (Gmail).

  6. The artist is not responsible for lost or deleted artworks once the commission was finished and sent. Please save and back up your commissioned pieces.

COMMUNICATION:

  1. The artist can be contacted through any of the social media accounts linked in their Carrd.

  2. For clients who ordered directly from VGen, all communications will be done on the website.

  3. The artist’s activity is based on their time zone (GMT +8). This is a reminder for overseas clients if ever the artist does not respond immediately.

PAYMENT & REFUND POLICY:

  1. Payment methods:

  • VGen (USD / International)

  • PayPal (USD / International)

  • Ko-fi (USD)

  • GCash (PHP)

  1. Payment first before starting the commission or until the sketch is approved. The client may choose to do 50% Down Payment or Full Payment upfront. Other payment plans must be discussed first with the artist.

  2. Full payment must be received before finishing and/or sending the final output.

  3. Full and Partial Refunds are allowed ONLY DURING CRITICAL CIRCUMSTANCES like the following:

  • (100% Refund) The artist has not started the commission for a long period of time after the client paid upfront or due to physical, mental, or technical conditions.

  • (50-60% Refund) The artist is not able to continue the commission due to physical, mental, or technical conditions.

COPYRIGHT & USAGE POLICY:

  1. The artist (Rinji Hei), by default, is the author and has the right to claim the products and services as made by her. Therefore, the artist is entitled of the following:

  • Authorship and ownership of the original characters, designs, and concepts made solely by the artist

  • Ownership and usage rights for portfolio building and self-promotion — post the commissioned artworks in their social media accounts; use the commissioned artworks as samples and materials for self-promotion

  • *Requests for confidentiality, non-disclosure agreements, and transfer of ownership must be discussed first with the artist.

  1. The client has no right to claim the products and services as their own work. By availing the artist’s services, the client is entitled of the following:

  • Authorship and ownership of the original characters, designs, and concepts provided solely by the client

  • Ownership and usage rights for personal use — profile pictures, headers, personalized items, desktop/phone wallpapers, etc.

  • Ownership and usage rights for commercial use — advertisements and other promotional materials, merchandise, print, freebies, streaming assets, content use, etc.

  • *Usage rights must be discussed first with the artist. Commercial fees may apply.

  1. Posting and using the commissioned artworks in social media must have proper credits to the artist. The client should mention the name or username of the artist or provide the link of the artist’s social media account/s.

  2. Removing or altering the artist’s watermark or signature is strictly prohibited.
